Lawsuit allegations
There was a False Claim Act lawsuit that was filed alleging that the military contractor known as 3M intentionally sold the 3M combat arms earplugs to the US military for a whole 12 years starting from 2003 all the way to 2015. In simpler terms, the said defects did not meet the set safety standards as set by the military according to the claims and complaints from wearers of the same which led them to develop permanent loss of loss or tinnitus as it is also referred to by some people.

Dual-ended defective earplugs
There is also a need to say something about the dual ended 3M combat earplugs that were also listed in the lawsuit which had green on one side and yellow on the other. Each of the colors was set to indicate a certain level of noise protection for the user but then the basic function of the devices was faulty considering that they were too short. The earplugs would also loosen subtly while in the user’s ears and both of the design shortcomings ended up exposing the military staff to the high and damaging noise amounts that resulted in hearing the loss in the end.

False Claims Act case about the outcome of Whistleblower
There was also a lawsuit verdict from July 2018 that found the 3M company responsible for supplying the US military with defective combat arms earplugs model CAEv2 without informing them that the devices would result in hearing a loss to the users as well. The US military, as a result, received a settlement of $9.1 million from the company which went directly to the government and it was used to compensate the victims of the case.
